TERMS AND CONDITIONS TO PARTICIPATE IN BIO-PAIX

By entering this contest, you agree to the following terms and you represent and warrant to COOPERA CONGO (COCO) that all registration information you submit is true and accurate. .

Eligibility

  • The contest is open to all artists fans, between 18 and 30 years of age and ensures that they do not violate any applicable law or regulation, or any agreement to which they are a party.

  • the contest is only and exclusively for residents of the South Kivu Province.Contestants originating from another province but currently residing in South Kivu will not be accepted. This contest wants to promote the cultural heritage de the tribe BASHI: in the territory of Walungu, Kabare, Kalehe, Mwenga; BAREGA : Mwenga, Shabunda, FiziBAHAVU: Kalehe, Idjwi; BAVARIA: Uvira; BAFULER: UviraBABEMBE: Fizi; BANYINDU: Walungu, MwengaBATWA: Kalehe, Idjwi, Kabare. This is cultural positive discrimination. 

  • Employees of the BIO-PAIX Talent Competition, COCO association, and sponsors cannot participate.

If the organization verifies that any of these requirements have been violated by the contestant, even if their work has been a finalist, they will be immediately disqualified. 

Copyright

All images, audio and video you will submit are either original artwork images created by yourself or are artwork created by an artist who has authorized you to submit the images on their behalf. Images submitted by the contestant must not violate the privacy rights, publicity rights, copyrights or other intellectual property rights of any person or entity.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

Without limiting our rights, our policy is to terminate all dealings with any copyright infringing artist upon receipt of infringement notification from the copyright owner or the copyright owner's legal counsel.

Accepted media

They are eligible:

  • Paint: it must be created specifically for the BIO-PAIX talent show. There is no mandatory dimension, it is left up to the artist. To participate in the contest, a photograph of the painting will be taken and sent by Whatsapp or by email. Recommended Specs: The photograph of the painting must have a minimum resolution of  300 dpi. The format should be JPEG or PNG. (pixels per inch or dots per inch, in English) is a good value, although at 240 dpi it can also be considered acceptable. For the Talent Show, the high-quality image will be 600 dpi. 

  • Photography: it must be created specifically for the BIO-PAIX talent show. The photograph can be retouched. This way it will be original, unprecedented, and will fit perfectly with the theme.Recommended Specs: format in BMP, GIF, JPG, TIF, and PNG (the best will be JPG). The minimum resolution will be 300 dpi (pixels per inch or dots per inch, in English) is a good value, although 240 dpi can also be considered acceptable. For the Talent Show, the high-quality image will be 600 dpi. 

  • Dance: the choreography must be created specifically for the BIO-PAIX talent contest. An individual person or a dance group can be presented. Both can participate individually or represent an association, educational organization, church, or other official group recognized by the Congolese State and which will receive the prize if they are winning talents. Recommended Specs:format in MP4 or MOV, maximum length 120 seconds (2 min), maximum frame rate 30 fps. If it is recorded with an Android or iPhone phone, it will be recorded in a horizontal position. The dance video may be retouched. Videos are eligible to record the dances with a minimum size: of 600 x 600 pixels.

  • Song: the choreography must be created specifically for the BIO-PAIX talent contest. An individual person or a dance group can be presented. Both can participate individually or represent an association, educational organization, church, or other official group recognized by the Congolese State and which will receive the prize if they are winning talents. Recommended Specs:format in MP3, AAC, FLAC, and WAV with a maximum length of 120 seconds (2 min).

Theme of the work

The artwork that you will send via WhatsApp or email will not include pornography, sexually explicit (semi-nude or nudity are allowed if they have a significant meaning that the artist will explain), violent and/or racist.

The thematic categories are the following: 

  • Mental Health Promotion

  • Peace Building

  • Protection of Biodiversity 

  • Mixed: you can choose two or three themes together 

Jury

The jury will participate in the online voting and in the Talent Show that will take place at the Lwiro Natural Science Research Center. This place is chosen for the promotion of rural areas. The jury will assess the face-to-face work of the 12 candidates selected by public vote. 

The jury will be made up of members of international NGOs that participate and finance the awareness and inspiration project through artistic expression for the promotion of mental health; peace building; biodiversity protection. Professional artists from the South Kivu province will also participate in the jury. 

If for any reason an announced jury is unable to judge the entries, the entries will be judged by the remaining jurors and/or alternate jurors.

Special criteria for the Jury

The Jury will have an assessment table that must be followed with criteria with different scores up to 100%. Both the gender, as belonging to the indigenous Batwa people and living in a remote rural environment will have an additional 10% in the score. Clarity in the message to be transmitted will also have an additional 15%, whether on the subject of protection of biodiversity, promotion of mental health, construction of peace or mixed subject. 

 Online Voting 

The works will be exhibited on a specialized internet platform so the public can vote for their favourites. We understand as the public all national and international person aware of said contest that wants to vote for an artist by thematic category (song, dance, painting, photography). That is, a person can only vote on the platform for a painter, a photographer, a singer or group, and a dancer or dance group. 

This modality is open to all nationalities worldwide to promote Congolese art inside and outside the national territory, regardless of gender, race, religion, or nationality. 

Once the online voting period is open, contestants will be encouraged to distribute the official link that allows them to vote for their work through any means. 

International NGOs and other professional artists who form the jury at the Lwiro Talent Show must also participate in the online voIfthat there is a tie between the work of two artists, it will be jury's vote jury who will deliberate on the contestant who will go to the next phase since their vote counts for 75%.

Selected Artists for the Talent Show

If your work is selected, COCO will send you an Art Enhancement Kit to improve the quality of your work, which will be presented at the Talent Show in Lwiro:

  • 3 Drawing talent support material kit: $150

  • 3 Kit of support materials for photographic talent: $150

  • 3-Song Talent Support Kit: $300

  • 3 Dance talent support material kit: $150

The 12 selected candidates will be invited to travel with their works to Lwiro, where they will be accommodated for 3 days in the "Guest Houses" available in the town of Lwiro. It will be your sole responsibility to deliver the actual artwork to COCO and ensure that it is framed and/or wrapped and ready for display.

You agree that you will follow all promotional and exhibition procedures at both the MUTIMA AFRICA Psychosocial Center and COOPERA CONGO has the exclusive right to revoke your participation if those instructions are not followed. If you cannot send the artwork to the BIO-PAIX competition organization, COOPERA CONGO will provide you with a monitor to display your artwork at the exhibition at no additional cost. Monitors will be provided to the first 3 selected artists who request it. On each monitor, we can display up to 5 images of your artwork.

Awards

  • The top four winners for painting, photography, dance and song will each receive a $500 cash prize.

  • The four runner-up winners for painting, photography, dance and song will each receive a $300 cash prize.

  • The four third-place winners for painting, photography, dance and song will each receive a cash prize of $150.

Sale of works of art online and in person during the Talent Show

  • Online store: COOPERA CONGO will create an online store on its Mutima Africa page to sell the works of "ALL" the participants in the BIO-PAIX talent contest, from the contestants without a prize to the winners. The BIO-PAIX online store will also have a space for the sale of works by professional artists from the South Kivu Province. The artist sets the price of his work and receives 80% of its retail price and the organization COOPERA CONGO receives 20% of the retail price. The 20% received by the NGO COOPERA CONGO will go to:

      - Biodiversity protection theme to the Lwiro Primate Rehabilitation Center. 

      - Mental health promotion theme to the Mutima Africa Psychosocial Center.

      - Thematic construction of peace to COCO's peacebuilding activities

In the online store, the songs and dance videos will be exposed to be acquired by the media, associations, international NGOs, or private persons with exclusivity once acquired, that is, to make agreements or sell on copyright. The NGO COOPERA CONGO will be a moderator in the sale favoring local artists.

  • Talent Show in Lwiro: It will incorporate an exhibition space for the purchase and sale of the works in situ. Prices will be established on the list/price with a 20/80 commission structure: the artist receives 80% of the list price/retail price and COOPERA CONGO receives 20% of the list price/retail price. public. The 20% received by the local organization goes to the aforementioned projects. 

Use of Images

We have the explicit right to publish the images, videos or audios of your artwork for online voting, with a special treatment of watermarks (or other means) to maintain copyright and prevent downloading of said images and use. unlawful third party

With permission and by signing an agreement, we will be able to promote the BIO-PAIX contest using the images, videos or audios on our COOPERA CONGO and MUTIMA AFRICA social networks, always indicating that they will be put up for sale and that this will help the amateur artist and continue with the activities of COOPERA CONGO. 

Image Retention

By sending your work of art by WhatsApp or email, you authorize us to keep the images of said work of art uploaded in our system until the end of the contest. In addition, you authorize us to keep said images after the end of the contest, during the year that the online store lasts. Once the contest period and online store have ended, they will be downloaded from the internet and from the COOPERA CONGO archives. We only keep those works that COCO wants to buy or that have been explicitly assigned by the artist. With this they can be used in the future for other contests. At any time after the end of the contest, you can send us an email to coco@cooperaong.org requesting that we remove such images. We will confirm receipt of the email and your images will be deleted within 10 business days of receiving our confirmation.

Fee

There is no fee to participate in the BIO-PAIX talent show. But you accept all the charges that your participation in the contest may entail. 

Changes in the calendar of activities

COOPERA CONGO (COCO) reserves the right to modify the terms and dates of the different stages of the contest due to circumstances beyond its reasonable control, lack of funding or logistical problems. 

Limitation of Liability

In the event that you file a lawsuit or file in any forum any claim against COOPERA CONGO, its agents, employees, representatives and/or officials, in connection with and/or arising out of any claim that is related in any way to your participation in the contest and/or our relationship with you in any way, the maximum amount of damages to which you will be entitled in all of your claims in total will be the greater of (a) the insurance proceeds received by either you or COOPERA CONGO in in connection with your claim or (b) in the event your insurance claim is denied for any reason and/or is not covered by the insurance policy, no more than the total amount actually paid to us by you in connection with your entry.

In the event that you initiate a claim or other legal proceeding against COOPERA CONGO or any of COOPERA CONGO's owners, officers, employees, agents, representatives or affiliates in connection with and/or arising out of any claim related to competition and/or our relationship with you in any way; a) you hereby unconditionally accept the exclusive jurisdiction of the state and federal courts located in South Kivu, b) the law of the Democratic Republic of the Congo will apply for the adjudication of any such claim and c) art contests of Sud Kivu shall be entitled to recover from you all of its costs and expenses related to any such proceeding, including, but not limited to, its attorneys' fees.

Compensation

You agree to indemnify and hold COOPERA CONGO, its owners, subsidiaries, affiliates, officers, agents, representatives and employees harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, in connection with any claim made by any third party. due to or arising out of your violation of any of the above terms and conditions and/or any breach of your covenants, representations and warranties set forth above.
